Carnival has a new policy.

Whenever you book a cruise they will send a physician or physician assistant to your residence for a complete medical history to make sure a guest does not have this type of problem.

Just booked a cruise on Freedom and I will be getting a call soon to make a reservation for my history.

It's been my experience that when you're consuming coconut cake ... or really anything with coconut in it ... you can usually figure it out by the smell and thus decide NOT TO EAT IT.

And c'mon ... it's not like this chick's throat swelled up ...

Anyone who plans on booking a cruise soon may as well write a check out to this woman, since that's who'll end up paying for it.

And the Burger King case mentioned at the bottom is even more ridiculous than the coffee suit against McDonald's. I think it's safe to say it's a pretty reasonable expectation that a buger is going to come with lettuce, pickles, and tomatores. He's on the warpath for free cash more than the bride is.

I don't understand how she couldn't smell the coconut either. Carnival is great about allergies.. I know because I have celiac. They went out of their way to make every meal special. She probably forgot to mention she was allergic to coconut. It is sickening how everyone has to sue for everything. It is easier to say they forgot about her allergy. They should check the records. I would publicize the records and show if she forgot. It is always easier to blame someone else than take blame yourself. YOu didn't die over that . Why don't you be a big girl and get over with. I went to a expensive restaurant . By mistake they cross contaminated my food. I even asked if it was gluten. I got deathly ill for 2 days. Did I think of suing? No, I didn't even think of it. We need to stop being so SUE happy. It is disgusting.

This lady is just out for a settlement, plain and simple! That is so ridiculous!! I hope she loses her case, but I bet Carnival will settle with her just to avoid going to court.

I thought the line about the "coconut cover-up" was hysterical! And, btw - I have had coconut cake on every Carnival cruise - both in the dining room and in the buffet. I look forward to my coconut cake! Perhaps those funny looking white shavings on the cake could have been a kick-off that it was coconut?

I think most of you are missing her point. She was specifically told what type of cake would be served and that was what she ordered. Since that didn't have coconut in it she didn't mention her food allergy. At her reception she didn't get the cake she ordered but rather something else that did have coconut in it. I have had plenty of foods cooked with coconut that you didn't know until you tasted it. If the top wasn't by chance decorated with coconut how would have have known it was in it. Maybe not life threatening but still makes for a horrible evening.

My sister can't eat actual coconut without having a horrible reaction, but she can have like coconut milk, etc so when something smells like coconut she has to be sure whether it has actual coconut shavings etc in it.

While not worthy of the damages she is seeking she should receive some sort of compensation as they should have informed her they substituted the cake with something else.

Why the assumption the cake icing had coconut shavings in it - my guess is it didn't which was why she didn't know it was coconut until she ate it.

I see your point in it's entirety. Yes, she did not get what she ordered. But she's also not suing for breech of contract, she's trying to sue for damages done to her by the cake. If she wanted to go after Carnival for not providing the cake ordered and get back that part of her money, more power to her. She's entitled. If she's trying to go after Carnival because she had an allergic reaction to a food she put in her mouth and more than likely had knowledge she was allergic to it, she has no case. No one at Carnival held a gun to her head and made her eat that cake. And like I've said, coconut has a specific fragrance. If she smelled it, she should have asked if it contained coconut, coconut milk, or coconut oil.

This is just like the idiot that had eaten oysters at one of the casinos down here and died on the way back home to Mobile. He and his wife both were aware that he was allergic to shell fish. She tried sueing the casino. The casino did not just roll over and fork out the cash. The case was dismissed by three different courts as not valid. Carnival will settle with them out of court for a "undisclosed" amount of money, just to make it go away. It will be cheaper for them than fighting it. I have eaten the coconut cake on every cruise that I have been on and have never had any trouble identifying it before I put it in my mouth.

Just FYI, coconut milk DOES contain actual coconut. They grate it and squeeze the liquid through a strainer. Some particles (which are just the plant fiber, really) will get through, though they are likely very small.

You are missing the point that she did not disclose her allergy, did you read the whole article? It said she didn't think coconut was possible so she did not disclose the allergy.
I know a few pastry folks and I know that coconut would absolutely be in the realm because it's often used in decorating if not in the cake itself.
IMO its more of the frivolous lawsuits popping up, people want something for nothing. It truly makes me sick.

Most people.. ok most people with a brain.. with allergies know to ask or tell someone they cannot have something. When she was told what flavors of cakes there were, she should have said ok as long as it's not coconut. It is her responsibility to let them know. They are not mind readers.

As far as the BK one, sheesh you can't see tomatoes, lettuce and pickles BEFORE you eat it?

I never said it wasn't frivolous or even retarded for that matter. However I can understand her point of being upset. I have often asked my sister how it is she can have some coconut and not others but strangely enough that is the case. She can for instance drink a pina colada with no problems as long as they didn't decorate the glass with coconut.

I even know of a dish on the Splendor for dinner last year, there was no coconut mentioned on the menu for the ingredients, when asked when it was served if it had coconut (sure looked like it did) she was told that it definately had NO coconut in it. I tasted it before her and advised her not to eat it because it tasted and looked like coconut to the rest of us. Goes to show the cruise line can screw up once in a while. I think all types of law suits like that are ridiculous and totally uncalled for.

I can understand her being upset as well, but she's pulling a Bridezilla here and should be suing for the price of the cake and not bringing a torts case with a personal injury lawyer. But the price of the cake ain't gonna pay her bills so ...
