Costa Med 11-20 the saga goes on

I am a travel agent. I have booked may cabins on the Costa Med 11-20

I have received no tickets. I would never let the public know the ugly world of behind the scenes with cruiselines and agency. But I feel it is vital to all that I enclose the situation with Costa and how they are attempting to defraud paying passengers.

Our agency has a group of cabins on 11-20-2005

20 cabins have paid in full and approximately 15 cabins who are from Korea have decided as of Nov 7 that they were not because of the condition in Cozumel. I had asked Costa in Sept if it would be possible to move these people to a later date -like January where they needed to sell cabins due to weather. This is also beneficial to Costa as they would sell cabins on low season dates. Well they refused to help and they refused to give us answers regarding the Itinerary. Our Korean guests decided not to go because they did not want to pay $3000 per couple for air from Korea to sail on an itinerary they did not want. We offered to Costa to resell the relinquished space and pay change fees and the did not respond, they only said when you get more passengers we will see what we can do, And then they sent us a debit memo for $14,000 for the cancelled passengers. I am copying the emails and entire situation to this board so you can see how terrible they are and they are the only cruiseline that has ever done this,. Royal Caribbean allowed us to move all of our passengers to different dates.

Here it goes

Here is the breakdown of the situation please be patient as it is very detailed, Our personal info is in the emails because we want everyone to know HOW MUCH we fight for our guests and we are going to our attorney at 2pm today

 

the situation

 

I had approximately 30 citizens of South Korea booked on the Costa Mediterranea

I also had about 30 US or Canadian citizens.

4 korean passengers decided to go and paid for their reservations in full

the rest of the Koreans have only paid $100 per person deposit pending confirmation of itinerary.

All of the US and Canadian citizens paid for their reservations in full as well which can be confirmed by reviewing my group fax.

 

All of the Korean Citizens refused to pay due to the fact that as of Nov 7 I was unable to obtain confirmation regarding the itinerary. In September when the first hurricane hit I called and asked if these passengers from Korea could be moved to another date based on weather and the Korean consulate was very slow in issuing visas. I could not get approval to move the passengers

 

I was told to wait, which I did since many factors are involved when dealing with international clients

 

I researched the air tickets that Costa is charging penalties for. I called in all the ticket numbers and many tickets were never issued. They were booked and immediately voided. I also confirmed that the cancellation per ticket is $100 per ticket-this is per the leisure support desk-at American. I also pulled up the ticket numbers on American Airlines https://www.refunds.aa.com and discovered that

many were voided, a few had refunds requested and some were never even booked-reservations were held but Costa never submitted payments to the Airlines.

 

Also Costa is charging the cancellation fee for the cruise which we asked for the opportunity to sell to new passengers, I received no response but was instructed to cancel. I called this morning 11-12-2005 2 days after all of our category 6 cabins were cancelled and was told by that all of those cabins are gone. Not only is it unethical for you to continue to charge us penalties for cabins that you have resold. It is illegal for you to make double money off of a customer and the only way you can possibly do this legally is if the ship were not sailing at capacity and Costa could prove a financial loss.

 

We asked for the opportunity to rebook the cabins and pay the name change fees involved. On Nov 11 I called reservations ay Costa and was informed that the category 6 cabins (the category we had to cancellled and were being penalized for

was now sold out)

On Nov 8 I faxed Anna Maria in air to request upgrades for reservation # 2222516

on this date I submitted a credit card for $1400 for

booking #2222474, Costa accepted a passenger's money for first class ticket upgrades, yet refuses to issue this clients tickets

 

The California Seller of Travel Laws and the Florida Seller of forbids the use of a customers funds for another individuals reservation.

Costa requires a third party credit card authorization if a passenger is paying for more than 1 passenger. The passengers who paid in full all paid for their own reservations. Costa is now claiming that they refuse to issue the tickets for the passengers paid in full and wants $14,000 from us -for the cancelled passengers,

Now let me explain something, a cruiseline will normally only hold a reservation as long as it has enough money to cover the cancellation penalties. Passengers #1 money cannot be used for passenger #2 reservation or penalties that is fraud and misappropriation of a clients funds

All of the tickets in open status can be cancelled or changed and American only charges $100 to do this which I advised the group department we were willing to paychange fees if they would have agreed in Sept to allow us to move group.

 

Also I have just received a press update that Costa is now going to Cozumel which was the reason we were having problems in the first place. Noone at Costa would guarantee where the ship was going and I found it unethical to charge passengers for a trip they do not want.

So today now that we can confirm where the ship is going there is no space n the ship to rebook the Korean passengers-space is gone we had 15 cabins.

 

Now another interesting twist

is showing as cancelled and refunded this morning in American's airline system

So what has Costa done with these passengers money? This is TOTAL fraud on COSTAS part-here is the email

I sent you an email earlier that I had called docs and Mirta said that someone needed to request them. I gave you the booking numbers of the passengers that paid in full

Also there are 4 passengers that have booked air from LAX

2 pax who paid $1400 to Costa on Nov8 for first class upgrades

I received an email confirmation from Ana Maria stating these 4 passengers were confirmed on AA0306

I called American and none of the passengers have tickets

Please make sure this is corrected.

Per our last phone conversation you stated that you were not issuing tickets for the passengers that had paid you for both cruise and airfare because of the other passengers that had cancelled.

You are defrauding the passengers who have paid Costa for the cruise and Airfare.

 

This is in violation of the Seller of Travel Laws, RICCO, Fraud, Negligence and Breach of Contract with the customers whose credit cards you have charged

 

Please let me know how you plan to respond
