While it may be more than has ever been done in the past, the ban is based on an existing CFR that give the CDC the power to do so.  42CFR70.2 grants them the authority, if the CDC feels that state or local measures are insufficient to preclude the transmission between states, to intervene with their own measures.  The CDC is saying that evictions could lead to infected persons traveling interstate to find housing.

however while they referenced that regulation, it only Grant's power to take action between states, not inside of a state when Insufficient action is taken by local authorities. they tried to stretch it out of shape with the eviction ban by making the claim that someone Ill might be evicted and then might travel across state lines. That certainly twists both the language and intent of the regulation out of all recognition.

They could impose a travel ban between States and be totally within their powers, but a eviction ban within states goes considerably outside of the regulation.

Now certainly the person that wrote it did an excellent job in trying to find a way to give the CDC those powers, but if it holds up, the CDC could do almost anything inside a state using the same logic.
