Not sure about the court case, but after reading the report it appears to me as gross negligence on the bridge of the Noordam.  I wonder if her Commanding Officer still had a job with HAL after that incident.  I spent many watches as Officer of the Deck underway on my last Navy ship, so I have some understanding of what was described in the report.  Incidentally, in June, 2005 we cruised from Dover to Copenhagen on the old Noordam.  We then boarded the new Westerdam from Copenhagen back to Harwich.  The difference between the two ships was enormous, and in every case we preferred the Noordam to the Westerdam.
