I've been wondering what happens if you are seriously injured while out at sea or in Canada. Does Kaiser/Medicare coverage still apply?

My next two cruises will be North American coastal, one Pacific and one Atlantic, but we will be offshore, and briefly in Canada.

Yes.  Google Kaiser senior advantage travel insurance.  There is a whole brochure and FAQ’s available.

When we were on Sky Princess in Alaska they had a photography display in the Piazza.  The pictures were really close to the raised area where the entertainers are.  Naturally you are looking at the pictures and wouldn't notice the "step".  The poor gentleman in front of me fell and went down so hard he flew into the wall, breaking his glasses. They took him via wheelchair to the medical centre.  When I saw him later on the trip he said he heard nothing and was quite upset he had been charged for the medical services.  There was lots of security right after the incident and the display was moved so Princess obviously knew they had liability.  Such a shame the gentleman didn't get an apology at the least.

Former lawyer here.  As others have said, the chances of winning a lawsuit claiming negligence are very slim.  Also, someone mentioned that you are unlikely get an apology that could be used against Princess.

 

You best bet would be to write a very strongly worded letter saying how angry you are at their lack of follow-up and implying that you might be feeling litigious.  I think Princess would be very eager to offer you some form of compensation to make the whole thing go away.  If you have a friend who is a lawyer who could write it for you, even better.  However, I don't think it would be worth the money to hire an attorney.

Kaiser Medicare Advantage here   We have always had to pay up front when out of the country and

then file for reimbursement

We were on Sky Princess last November, sat in the Princess Live! area. Over two weeks, we witnessed three separate incidents where people physically fell on a step in the venue. One lady took a particularly nasty fall. If you walk into Princess Live! and walk parallel with the stage, there is a small step about 2/3 way in to the area which goes up into another sitting area. It is poorly lit and if you are carrying a drink and trying to avoid people seated, it is very easy to miss. Princess must know this.

Excellent advice.  If something on board does happen ask for copies from the doctor on board and the security report.  Have assisted others in receiving compensation while they are still on board by discussing with the Hotel Director.   Easier in my experience to receive compensation for a non permanent injury on board.

I have not read the postings, but anytime I fly/cruise, I always take out insurance, for "just in case." Should someone on Princess apologized for what happened, yes. If you did have insurance coverage you need to file this as a claim.

Sometimes you don’t have to win the lawsuit, you just have to have enough of a case that they’ll settle for a reasonable amount rather than pay the cost of defending it.

I had specifically asked for a cabin on P&O which had a shower only and not a bath.

I had also requested a shower chair. When we got on board we were given a room with bath.

I spoke to the steward who sent the Hotel Services Manager to my cabin. Next the steward arrives with a stool to put in the bath.

When I went to have a shower one of the legs gave way. Fortunately, my partner was in the cabin and was able to help me.

I reported the incident to the Health and Safety officer and he made a report.

When I returned home I wrote a letter to the CEO and received compensation.

In this case not only should compensation be paid, but there should never have been a charge for the medical treatment.

If everyone who fell on a cruise sued the courts would be tied up for years and the ambulance chasers would be lining up at piers I tripped over a poorly parked scooter in the casino and broke 3 ribs never thought about a lawsuit or complaint

It wasn’t a lawsuit at all. I wrote a letter of complaint to the CEO of P&O and was offered compensation. Nothing more. At the end of the day they were at fault.
