Man Overboard Oasis - Picked up by Disney Magic

If a "wave" can knock a passneger off a deck on the biggest ship in the world, I'm never stepped outside my cabin on a Carnival ship again

While many are going to comment on him getting "knocked into the water", the issue that is being discussed and is actually quite scary is that they didn't know he went overboard. Maybe the ship holds too many people and they can't keep track of them?

You are pretty much an exclusive Carnival cruiser. You gonna tell me that a Carnival ship knows where every passenger is 24 hours a day?

Get real, Walker is a scumbag tort attorney

and how would you suggest they track and monitor each passenger? we each wear a tracking bracelet or GPS device on us so they know where we are at all times? People need to take responsibility for themselves .. its called being an adult.

Get real ... .

I wonder how he wasn't seriously injured or killed by falling off the front of the ship. I think he would have had to thrown a long ways sideways not to be run over by the ship.

My thoughts exactly. Brings to mind "Keel hauling" which might be appropriate if this guy was doing something stupid enuff to fall overboard at night...

This story just seems a bit lame. I'm glad the guy survived and was rescued, but how come nobody else saw a wave that had to be…what?…60-80 feet high? And this was 8 miles out of the port of Cozumel? And 4 other cruise ships sailed by before the Disney Magic spotted him in the water? And there's no mainstream news coverage?

I know there's a story here, but I don't think it's the one being told! Drunk? Stupid? Drunk and stupid? Climbing on the rail for a selfie? Jumped overboard and came up with a cover story upon rescue?

Maybe he was trying to win a Darwin Award.

I think he might have been: (choose one or more)

-drunk

-trippin' on something other than booze

-stupid

-some combination of the above

-texting and not paying attention

-climbing on the rail to take a selfie

-jumping overboard, then had to come up with wild cover story involving a huge rogue wave when he survived

-trying for a Darwin Award

It's the only way I can spin this story into something that makes sense.

I'd like to hear the full story on this....the real one. No news media has picked up on this here in South Florida and they're usually the first ones to run to the RCCI building on Dodge Island to get the scoop. Really strange. There's a lot more to this than meets the eye and we're not being told something....or anything for that matter. This is just too weird to be true as posted. What's missing?

I assume the truth from the passenger. A wave that large would have REALLY been noticed.

The only way someone could get "knocked off" the Oasis by a wave would be if they were practicing a balance beam routine using a railing during a tropical storm. There's a lot to this story that hasn't been published yet.

He says he was on the bow of the ship when a large wave caused him to fall into to the sea.

The guy was at the bow doing his best Peter O’Toole does Leo DiCaprio in Titanic impression; “I’m the King of the worl…………………………………….d.”

That had to be one crazy wave. Where they in a monsoon???

Sounds like he was doing something he shouldn't have, like sitting on the rail and fell in. Then had to come up with another excuse to blame it on the ship/ocean. Also, if he was on the bow, the watchers/spotters up on the bridge should have seen him.

To say nothing of the fact that the helicopter pad/bow area on the Oasis isn't open to the public.

Is it possible you honestly believe the ship needs to 'keep track' of the guests?

BE RESPONSIBLE FOR YOURSELF people!

I'm actually sitting here shaking my head at the absurdity of some people.

DH was able to go out on the deck of the Jewel as the winds of Hurricane Sandy were picking up. We had 20-25 ft waves and winds better than 40mph and he was still safe in the lee of an overhang - but they shut the doors and roped them shut just minutes after he came back in.

Believe me, there's no way you could miss a rogue wave big enough to knock someone off of Oasis. You couldn't even miss the 30-40 ft waves we got later that night fron Hurricane Sandy, things were falling in the bathroom, in the gift shops, chairs were sliding across our balcony, and a rogue wave big enough to go over the bow of Oasis would have had to be at least that size.

How should they keep track of all the people? Would we need to have chips implanted when we check in? Wear ankle brackets at all times? Since this happened in the pre-dawn dark, what do you suggest that would immediately let the ship know a passenger went overboard? How does Carnival accomplish this?

Like this story…in the 2012 Carnival Destiny incident, the ship crew did not know about the guest overboard until it was reported by witnesses. So the Destiny's man-overboard-notification-system, whatever it is, clearly doesn't work. (Or maybe it does work - maybe it's a system that depends on somebody seeing a person go overboard and reporting it.) Or maybe they also had too many passengers 'to keep track of?'

Sarah Alexandra Badley Kirby was on a five-night Caribbean cruise onboard Carnival Destiny in October 2012 when the incident occurred. Though Kirby alleges in her lawsuit that she fell from her balcony, witnesses told Carnival Cruise Lines she jumped.

According to Courthouse News Service, lawyers for Kirby wrote that after becoming "extremely intoxicated," she stepped on to her balcony for air. "As she was holding on to the balcony's wooden banister, the plaintiff lost her grip and balance, slipped off the ground and fell overboard into the ocean."

Kirby alleges in her lawsuit that despite a friend immediately reporting that Kirby went overboard, the captain of the ship refused to stop or turn around until a 90-minute shipwide search had been conducted.

Once the ship did turn around and rescue Kirby from the water, she claims ship doctors refused to treat her injuries (including multiple broken bones, lung contusions and blood clots), giving her only pain medication. Additionally, she claims Carnival refused to airlift her to a hospital in Miami, instead diverting the ship to Key West.

Kirby further accused Carnival of getting her drunk by "pushing" Long Island iced-teas on her and encouraging her to drink more by giving her free $5 casino coupons each time she purchased more drinks.

She is suing Carnival Corp., as well as four people, including two of the doctors on the ship at the time, for negligence and intentional infliction of emotional distress.

Quite scary!

What do you bet this Oasis case will generate a similar lawsuit? Looks like the lawyer's already been retained...
