Bad Behavior by Carnival result in Lawsuit

Why would Carnival get sued? It was a mistake, sucked for him being falsely accused, that wasn't their fault, they were told by another passenger that he did something. Yes, they should have checked video surveillance before the interrogation, shame on them, but they offered him a meal in a specialty restaurant to make up for it. I would have personally pushed for something more, maybe an excursion or OBC, but they didn't ignore it.

I think you need to go back and watch the YouTube video again. He deserves a lot more than a free excursion.

You cannot sue Carnival, nor most any other cruise line.

Suing a cruise line is next to impossible.

Pointless...when you accept a cruise contract you cannot, thereafter, file suit. (arbitration clause, to be executed in Miami, USA)

Not to mention that other than an hour of his time, there weren't any damages. Nobody would win such a ridiculous law suit.

The fact that they exposed his room number was wrong and the fact that they didn't try very much to match the description of the perp besides race, especially when they had video was really wrong.

They didn't expose his room number, he called security after a passenger came to his room accusing him, a passenger, not an employee.

Of course Carnival can be sued and they should be happy to pay this man and it should cost them much more to train their employees. The behavior was egregious from the unreasonable questioning asking for a confession, to the "all Asians look alike" to the specialty dinner offer. Seriously? Hard to believe they even kept his cruise fare. This is disgusting. Nobody should make any excuses for their behavior. Maybe you'll never hear about this one again because they will give him the money if he promises never to discuss this in public.

Or, like anyone else in the world accused of a crime FOR AN HOUR when when they were innocent, he can go on with his life and Carnival can continue doing business as usual. And future passengers, especially those with kids, can feel safer knowing they take these things seriously.

If you can't sue or if it's almost impossible to sue, then you get creative and hit them in the pocketbook. Corporations want to protect their goodwill so you hit them there. It may take a while but it can be successful. Anyone remember United Breaks Guitars?

You need to watch the video again. It states that they showed the wife pictures of guests on board (Asian guests I assume) and when she saw one she thought it was she saw the cabin number. Badda boom badda bing wifey tells husband the cabin number ergo confrontation at the wrongfully accused cabin door. Now I know Carnival doesn't have the cabin number on your cabin key card like the video shows so it must have been a data field on the info file that she saw.

Why would passenger feel safer or that this matter was taken seriously when the person who did it was never found. And a innocent person was accused and they didn't even do at comparison before interrogating him? It looks like they didn't do any type of investigation.

Being falsely accused is a ridiculous reason to sue, and there were no damages. Possibly endangering the guest by sharing his room number, even accidentally, and failing to investigate an actual assault against the accused by another passenger is a bigger deal, but still, unless damages are done to the passenger or his property, I doubt he has standing to sue (doesn't mean he cannot try). If he was injured, then it is arguable that Carnival would share some liability. The free dinner sounds like a way to try to make up for the inconvenience of being interrogated for an hour for a case of mistaken identity and shoddy investigation practices. Either way, I doubt this will go anywhere.

If nothing else, the father should have been thrown in the brig for assaulting another passenger. He should have reported it and let Carnival take care of it.

Onceapon a time someone was falsely accused of shoplifting in Walmart....sued and settled for a million dollars. So yes it can be done!

I work for a law enforcement agency. Unfortunately, people do accuse the wrong person and officers or detectives have to investigate. As you can imagine, guilty people also claim to be innocent. It's not like you go to someone who's been accused, say "did you do it" the person assures you they are innocent and you say, "oh, sorry - must have the wrong guy." You have to question the person accused. Do some officers come off as jerks - yes, they do, but when an accusation is made, we have to investigate.

There have been numerous instances of a females purposely giving a false statement to get back at an ex or to explain why she was out all night. We do file charges against those women for filing a false police report, but if someone makes a mistake and picks out the wrong guy, it's not actionable.

If law enforcement agencies were sued every time they question an innocent suspect, we'd all be out of business.
