Florida resident here a little confused over C19 protocol.

There are a lot of things the cruise lines do as soon as they hit international waters (duty free, gambling, etc) Why is this different?

Won’t be dropped unless a court invalidates the law. Now, that may happen but DeSantis can’t unilaterally withdraw the prohibition now that the Legislature passed it.

While in port, the ship is operating in the State, that's why the casino is closed and you have to pay taxes on drinks even with the beverage package.

I don’t recall paying any taxes on a drink in port prior to castaway (Florida).

A total dismantling of the legislation is not required.  The cruise lines take advantage of a loophole, work something out with the Governor or show that the law does not apply to them in court if necessary.  Any way they go is a win.

They most certainly have no jurisdiction as to what a cruise line asks for, and what services they provide or deny while onboard as soon as that ship is 12 miles out at sea.

 

People can argue letter of law, intent of the law all they want. Once you have left FL, there is nothing that law can do.

 

Well if this be the case, then the CDC loses its jurisdcition when the ship hits international waters.... correct?

I have if I bought a drink. We didn't pay anything as STAR passengers on Allure in PE

Honestly do you think carnival would announce vaccinated cruises from Galveston if they didnt already KNOW. Its florida that they cant announce, not texas. 

 

It's obviously florida that held up this announcement, texas was never the issue except in some minds. I'm betting my sept vista is vaccinated though they only said to start and not a end date.

There's like a gazillion threads on CC about drink taxes in port.  And the casino is still closed.

We are vaccinated and really don’t want to wear a mask onboard. I believe the State of Florida has a lot of control over her Ports. I’m sure they are in conversations with the Cruise Industry. Anything we opine here, is merely speculation. I would think the two working together will work this out.

Yes, however they have more jurisdiction on the disembarking so they can force lines to maintain health protocols or deny then re-entry.

 

Can FL deny re-enty if FL law was not enforced in international waters? Perhaps, but that would not be the $5,000 fine, that is a totally separate consequence that is not spelled out in the law.

 

FL can not enforce their law in international waters any more then they could enforce FL law in NY

Those are for shipboard purchases. At least in my personal experiences

No.  The legal concept of "free pratique" applies, so in order to reenter the US, the ship must comply with federal law throughout its voyage.

I think everyone is overthinking this.  It is process.  You either need a Covid Test (international travel) or a Vaccine.  If you show the vaccine, you don't need the covid test and all is good.  You will not be denied boarding by Florida Law if no vaccine.....however, the covid test is another issue. So the vaccine is not "required".

 

On a side note....anyone that is concerned or worried......please don't go.  The rest of us are fine

Maybe it’s because we always prepay for the Drink Package. I swear, we have NEVER paid taxes on a drink while docked in a US Port. How is that being argumentative if it’s a fact. I agree regarding the Casino and I didn’t counter that fact you posted. 
 

Well, those Gilzillion threads must be wrong as it relates to the Drink Package.

Florida law says you can't require proof of vaccine to enter your business, not that they can't optionally ask if you've been vaccinated.
