Norwegian has said Florida's law would prevent the company from ensuring at least 95% of passengers were vaccinated so it could comply with health regulations when it conducts its first post-pandemic voyage from Miami on Aug. 15.""

Next stop is 11th circuit. Then 11th circuit en banc. Then Supreme Court. It'll be a while.....

The real issue now is whether or not the injunction that was issued against Florida will remain in place through the appeals. If it is canceled along the way, it could change NCLH sailing plans. Although the Judge's opinion augers well for its continuance.

In law, an en banc session is a session in which a case is heard before all the judges of a court rather than by one judge or a panel of judges selected from them. (wikipedia)

 

So there is another group of judges deciding before going to the Supreme Court.  This will take time.  Good for us!

There also will eventually be another round for the preliminary injunction (PI) to become a permanent injunction. The good news is, one of the criteria for a PI is a strong likelihood of winning on the merits.

I agree.  Given the rate of infections these days, especially in Florida, then any intelligent judge (I am already asking a lot) would side with NCLH and not with the governor.

I also think that stays consider the harm done if issued.  IMHO, there is no harm in putting Desantos' edict on hold.  The cruise business and its Florida employees will prosper and possibly, fewer people will become severely ill and/or die.  Versus?????
